Nib Terms of Service
These Terms of Service ("Terms") govern your use of the Nib application ("Nib", "the app"), published by Bear King Digital ("we", "us", "our"). By installing or using Nib, you agree to these Terms. If you obtained Nib through the Microsoft Store, your use is also subject to the Microsoft Standard Application License Terms; these Terms add app-specific detail and are not intended to reduce any rights you have under applicable law.
1. The app and your license
Nib is a handwritten-notes app for Windows 11. We grant you a personal, non-exclusive, non-transferable license to install and use Nib on devices you own or control, for personal or internal business use, subject to these Terms and to the store terms under which you obtained it. We reserve all rights not expressly granted.
2. Your content is yours
You keep all rights to the notes, drawings, text, PDFs, and images you create or import in Nib ("Your Content"). Nib is local-first: Your Content is stored on your own device, and we do not operate a server that receives it. We do not claim ownership of Your Content and do not access it. You are responsible for Your Content and for keeping your own backups.
3. Optional third-party services you choose
Nib includes optional features that connect to services you choose and control. They are off until you turn them on:
- AI features (bring your own endpoint). When you configure and use them, Nib sends the text you select to the AI endpoint you specify, authenticated with the API key you provide. Your use of that provider is governed by that provider's own terms, under your own account. You are responsible for the endpoint you choose, your API key, and any costs, data handling, or outputs of that service. We do not control and are not responsible for third-party AI services or their results.
- Google Drive export. When you choose to export, Nib sends the notebook to your own Google Drive using your authorization. Your use of Google Drive is governed by Google's terms.

4. Purchases
Nib is free to install. Some features may require a one-time in-app purchase ("Nib Pro"). Purchases are processed by the store you bought through (for example, the Microsoft Store), and billing, refunds, and payment disputes are handled under that store's policies, not by us. We may change which features are free or paid in future versions; a purchase you have already made remains yours under the terms in effect when you made it.
5. Acceptable use
You agree not to: use Nib for unlawful purposes; attempt to reverse-engineer, decompile, or circumvent technical protections except to the extent applicable law expressly permits; resell or redistribute the app; or use it in a way that infringes the rights of others.
6. Disclaimers
Nib is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy of handwriting recognition, or uninterrupted or error-free operation. Handwriting recognition and AI features can and do make mistakes; do not rely on them in situations where an error could cause harm. You are responsible for backing up Your Content.
7. Limitation of liability
To the maximum extent permitted by law, Bear King Digital will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of or inability to use Nib. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including certain consumer rights). Because some jurisdictions do not allow certain limitations, some of the above may not apply to you.
8. Changes and availability
We may update Nib and these Terms from time to time. Material changes to these Terms will be reflected by the "Last updated" date above and, where appropriate, noted in the app's store listing. We may add, change, or discontinue features. Your continued use of Nib after an update takes effect means you accept the revised Terms.
9. Termination
You may stop using Nib at any time and uninstall it. When you uninstall, your notebooks in your Documents folder are intentionally left in place so you do not lose your notes. The provisions that by their nature should survive - including content ownership, disclaimers, and limitation of liability - survive termination.
10. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply instead.
