trackanything Terms of Service
These Terms are a legal agreement between you and Bear King Digital ("we", "us") governing your use of the trackanything app and website (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Important, please read
- trackanything is not a medical device and does not give medical advice. It is a general-purpose lifestyle and organization tool.
- Reminders are best-effort and may be delayed or fail. Do not rely on them for medication, medical, or any safety-critical timing.
- The Service is provided "as is." Keep your own backups of anything important; the app has an export feature.
1. Who can use the Service
You must be at least 18 years old, or the age of majority where you live, to use the Service. By using it, you confirm that you meet this requirement.
2. What the Service is
trackanything is a general-purpose personal tracking tool. You define what you want to track, log events over time, see them on a shared timeline, optionally set reminders, and optionally sync across the devices you pair. It is a lifestyle and organization app, nothing more.
3. Not a medical device, and no professional advice
trackanything is not a medical device and does not provide medical, clinical, health, legal, or other professional advice. It is not intended to diagnose, treat, cure, monitor, or prevent any disease or condition, and it is not for any safety-critical use. Anything you track, and anything the app shows, is for your own personal, informational, and organizational purposes only.
Always seek the advice of a qualified professional for any medical or health question. Never disregard professional advice, or delay seeking it, because of something in this app. If you may be experiencing a medical emergency, call your local emergency number.
4. Reminders are best-effort, do not rely on them
Reminders and notifications are provided on a best-effort basis and may be delayed, duplicated, or fail to appear entirely. Delivery depends on your device, its operating system, your notification and battery settings, network conditions, and platform limits outside our control.
Do not rely on the Service for medication timing, medical schedules, or any other situation where a missed or late reminder could cause harm. Use an appropriate dedicated system for anything safety-critical.
5. Your content
You own the data you create in the Service ("Your Content"). You grant us only the limited license needed to operate the Service for you: to store Your Content, sync it to the devices you pair, and display it back to you. We do not use Your Content for advertising, and we do not sell or share it (see the Privacy Policy).
You are responsible for Your Content, including any information about other people that you choose to log. You confirm you have any consent or right needed to record that information.
6. Your credential and recovery code
The Service uses a device-based secret and a recovery code instead of an account and password. You are responsible for keeping your recovery code safe. Anyone who has your recovery code can access your data. We cannot recover, reset, or restore it for you; if you lose it and have no synced device, your data may be unrecoverable.
7. Acceptable use
You agree not to:
- use the Service unlawfully, or to store or share content you have no right to;
- attempt to breach, disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its backend;
- use the Service to harm, harass, or violate the rights or privacy of others; or
- resell or commercially redistribute the Service without our written permission.
8. Beta and pre-release software
Parts of the Service may be distributed as beta or pre-release software, for example through Apple TestFlight. Pre-release software may be incomplete, may change or be withdrawn, and may contain errors. It is provided for testing "as is," and features may not be final.
9. Availability and changes
We may add, change, suspend, or discontinue any part of the Service at any time. We aim to keep it running but do not guarantee uninterrupted or error-free operation. Keep your own backups of anything important; the app provides an export and backup feature for this purpose.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that reminders will be delivered, that the Service will be uninterrupted or error-free, or that Your Content will always be available or accurate.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of, or inability to use, the Service, including any harm arising from a missed, late, or failed reminder. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) US $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to indemnify and hold us harmless from claims and expenses arising out of Your Content, your misuse of the Service, or your violation of these Terms, to the extent permitted by law.
13. Termination
You may stop using the Service at any time and can erase your data using the in-app controls. We may suspend or terminate access if you violate these Terms or use the Service in a way that could harm the Service or others.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute not subject to arbitration or small-claims court will be brought in the state or federal courts located in California, and you consent to their jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update this page and its effective date. Continued use of the Service after a change means you accept the updated Terms.
